The above listed Cosigner hereby agrees to be jointly liable with the Tenant for all of the Tenant's obligations that shall arise from the attached Residential Lease Contract that is attached to this Cosigner Agreement. The Tenant's obligations include but are not limited to any unpaid rent, damage to the property, and repair costs and cleaning duties. The Cosigner also agrees that the Landlord has no obligation to notify the Cosigner if the Tenant fails to follow the terms of the attached Residential Lease Contract. The Landlord may demand from the Cosigner to perform all the obligations of this Cosigner Agreement before first using the Tenant's security deposit to meet those obligations.
If the Tenant chooses to assign or sublease the above listed Property, then the Cosigner will still remain completely liable under the obligations of this Cosigner Contract for any lack of performance by the new assignee or sub-lessee.
For the complete term of the attached Residential Lease Contract this Cosigner Contract shall remain in full force. The Cosigner hereby appoints the Tenant as agent for the service of process if a lawsuit arises out of this Cosigner Agreement.
If there is any legal proceeding that arises out of this Cosigner Agreement between the Landlord and the Cosigner, the prevailing party will recover all attorney fees that are reasonable, court costs, along with any additional costs that are reasonable and necessary to collect a declared judgment.
